“This case boils down to a woman who, basically, tortured a child,” said prosecutor Sandra Eastwood, “becoming so enraged she forced him to have 23 teaspoons of hot pepper and then watching him die in agony.”
This much talked about case has put everyone in dilemma if this 29 year old pregnant women, a mother of four, could kill a four year child, who was convicted in Aug’06.
“Something was wrong with Andrew. I don’t know exactly how or what happened to him,” said Overton. “Something caused his sodium levels to rise, and it wasn’t me.” JuJu Chang’s report airs on “20/20,”
Hanna Overton and her husband Larry, were on the verge of adopting this foster child. Supposedly, that day she had fed Andrew the whole meal. But sometime later he started throwing a tantrum to get more food, so she gave him few dashes of Creole seasoning in a sippy cup of water. But that didn’t calm him, he started vomiting and fell on the floor. Larry and Hanna rushed him to the hospital after an hour and a half, they realised it wasn’t a regular flu. Blood tests soon revealed that he had salt poisoning, or hypernatremia. Andrew’s levels were off the charts — almost double the norm and among the highest ever recorded. The Overtons’ story aroused the suspicions of doctors and investigators. The next day Andrew died and the devout Christian couple, which had no criminal history, became murder suspects. As the investigation continued, authorities developed a theory that Andrew’s death was an intentional poisoning.
“We were just waiting for someone to look at it and say ‘This is just an accident,’” Larry Overton told “20/20.” “Instead, we were arrested.”
But, backed by a community of fervent supporters they claimed there was a rush to the judgement and the authorities had never considered alternate version of the case. The Overtons said that in the four months Andrew had lived with them, he had exhibited excessive tantrums and obsessive eating. Hannah says she started noticing that Andrew was hoarding food, stealing off the other children’s plates and throwing tantrums after meal time was over. At times, they say, they caught him trying to eat things that weren’t even edible. The Overtons believe this unexplained behaviour might have been linked to Andrew’s death.
The investigators questioned their children and revealed that Andrew was given unusual forms of punishments. Also, when Andrew was rushed to the hospital, the Medical staff testified, he had bruises and scratches on his body, which suggested, it could be a sign of struggle or abuse.
“Could it be that you held his nose, held his neck and made him drink this horrible concoction?” prosecutor Sandra Eastwood asked at trial.
“Absolutely not,” Hannah Overton testified.
Andrew’s former foster mother Sharon Hamil testified that the boy seemed perfectly healthy and never exhibited odd or excessive eating. Also, the prosecutors said she could have called the 911, when she saw the little boy in that horrible state.
“I think he was in one of his feeding binges, he was having a tantrum, and he was unsupervised for a brief period of time, and I believe that he ingested a large amount of salt.” Moritz has written extensively about salt poisoning and its connection to pica. “When I pulled all the cases of salt poisoning, they all fit the same profile,” he said. “Children within that age group of two to six years of age, in foster care from abusive homes but with behavioural problems, who had history of pica, who by all accounts appeared to have voluntary ingested large amounts of sodium.”
For his part, Moritz doesn’t believe Hannah Overton knew Andrew was dying.
To find Hannah guilty, jurors had to believe either of two scenarios — that Hannah force-fed Andrew Burd salt knowing it would kill him or that she neglected to get medical help fast enough knowing that he was dying.
Larry Overton also faced a charge of capital murder, but pleaded no contest to negligent homicide in return for five years’ probation.
Since Hannah Overton’s trial concluded, Larry Overton has been a single father of five. Once a month, he packs them into the family van and heads north. It’s a 300-mile drive, but no one complains, because for two hours the Overton children visit their mom at a Texas prison, where she hopes her case will be overturned.

INNOCENT!!!

I watched the ABC news 20/20 special on October 24, 2008. What Happened to Andrew? I was appalled by the travesty of justice! Needless to say I was greatly disturbed and disappointed over the fact that Caller Times helped inflame an ungodly perception of the Overtons which lead to an unjust conviction.

DWhy Did she put creole seasoning in a sippy cup? and how much did she put in? Why not make a mac and cheese and hot dogs or peanut butter and jelly sandwich? or toasted cheese? why seasoning? Thats absurd. and they waited so long to take him in?
anyhow they need to let her take a polygraph If she passes let her out. She can take parenting classes. Feed the kids not seasoning mix wth even cup of noodle pot pies

Andrew ate two bowls of chili & he wanted a 3rd bowl. She didn’t want him to eat too much. (He had a tendency to eat until he threw up.) So she took a little of the seasoning she used in the chili & sprinkled it into water for him to have a little bit of the flavor without it being too much for his little tummy.
Andrew threw up & said he was cold. She bundled him up & laid him down for a nap. It was not obvious Andrew was in serious trouble. When it did become obvious, they took him to the clinic.

This is not about Christians being persecuted. Hannah Overton’s church has unfairly martyred Hannah Overton to collect more money. Many honorable doctors who actually examined the victim in relation to this case testified. This is unbelievable. This woman was a nurse. She knew better. The victim, Andrew, had no behavioral problems and no eating disorders, per the foster mother (the only one the victim had) who took care of him for 18 months immediately prior to the murder. The very Doctor who came out as the supposed savior for the defense by saying the victim had behavioral problems and that it was all just a terrible accident totally discredited himself when he admitted to: writing a report right before the murder stating that the victim had NO behavioral problems, stating to other Doctors before Hannah Overton’s capital murder jury trial that she (Hannah) “ought to fry” , being listed by the defense as their number one defense expert prior to the trial, and admitting that he was not specially qualified as a forensic psychiatrist or medical examiner. The actual Doctors who had knowlege of the case testified at trial- these included a world expert Pediatric Criticial Care expert and a highly regarded medical examiner who actually examined the victim in relation to this case.
What other parents have ever been prosecuted in Nueces County or in any other County in Texas for withholding medical care. Not 1. This is not about persecuting Christians or parents or foster parents or adoptive parents. This IS about a little boy who was forced to sleep on plywood- Hannah admitted this the night of the murder on tape – not allowed to eat except breakfast, per the Overton children’s own taped interviews, not allowed to use the restroon, having his sheets burned, burn marks on his body, bruising all over this body that were attributed by all of the medical experts who actually saw him to abuse, a head injury and an overdose of sodium poisoning- which Hannah admitted to administering the night of the murder to an ICU Doctor (before her $ 700,000 defense team materialized and came up with “explanations for every injury” and twisted this into a persecution of a religious martyr.). Hannah, by her own taped admissions, admitted to seeing the victim drift in and out of consiousness for two hours and going into shock and struggling to breathe for two hours. She had special training as a paramedic and even had CPR gear. She called everyone but 911. Larry told his mother they didn’t call 911 because the victim was covered in bruises and they were scared of losing their own biological children. The foster mother who watched Andrew continuously for 18 months before the Overtons took over right before he was murdered (he was only with the Overtons for a few months before the murder) attended the Overton church and is very kind. She has adamantly stated that Andrew had no disorders. It is appalling that the Overton supporters would attack a 4 year old boy in order to try to “save” the Martyr, Hannah Overton. It is also appalling that they would turn this into a scare campaign, trying to act like all parents would be at risk of this kind of prosecution. How ridiculous.

Rhonda, you are the voice of reason! I agree completely!
Comment by getfactsright — January 17, 2009 @ 8:20 pm |
Despite her claims, Hannah’s trial, verdict, and sentence were fair and just. Her story does not pass the smell test and did not fool the jury or judge. Her deserves to stay in prison. The lies about the judge, jury, and prosecution are vain efforts to free a murderer.

she is GUILTY…..first of all you NEVER put seasoning in your kiddos sippy cups. I am a mother of two boys, one is 2 years old and the other is 5 months now and I AM STRESSED the heck out quite a bit but NEVER would I put seasoning in a cup for my son….and especially if I knew that he would consume ANYTHING…I mean if you know your child is sick with an over-eating disorder then the last thing you would want to give him would be a salt-flavored beverage especially with diabetes ect….look I don’t think she MEANT to kill him yet she did indeed. and just because that wasn’t her intention…(to kill him) it doesn’t mean she is innocent of murder….at least manslaughter…anyways….I wouldn’t ever ever ever even think about putting that trash in my son’s cup and he eats and drinks a lot himself….he has eaten until kinda stomache achy two or three times without me noticing beforehand to take his food away…..BUT never ever would I……. A. starve my child….my son knows when he’s full at age 4 sorry…..B. put seasoning of any kind for that matter directly in his sippy cup filled with water only…….not even kool-aid at age 4 cause that stuff has too much SUGAR……and finally C. allow my child to vomit and deficate repetitively over and over without seeking medical attention. SORRY those are just three things that she DID DO and makes her GUILTY in my opinion. and then to top it all off she took her other child to her neighbor’s home so he/she wouldn’t have to be involved I am guessing….and she went on to tell her friend/neighbor that Andrew was “pooping everywhere on purpose and rubbing it all over the walls despite her”. OK…that did it for me…and that friend TESTIFIED in a court of law to that statement. I mean like I said above TRUST ME…my son cannot poop on PURPOSE I mean who can take a shit on command???? tell me who? and then to think this poor child was suffering and just feeling HORRIBLE and here she is taking time to run her other child to the neighbor and also taking the time to verbally bash the poor little fella and then she goes back to the house only to call her husband to come HELP HER. HELP HER??????????????????????HELP HER??????????HELP HER????????HELP HELP HER?????????????? What is wrong with this question? oooooh oooooh me, me,….I know the answer…she was pregnant and moody and only thought of herself in the aspect of the fact that she knew she had fed her son a lil too much salt seasoning creole….fucking WHATEVER the heck it was….then she never even thought to call the ambulance, to cover her own ass cause she knew she had given him salt/seasoning and she was already panicked/stressed enough ect….she thought it would all end over the toilet and the next day everything would be fine….BUT HE DIED. DIED. DIED. DIED. DIED. DIED. I mean what don’t people understand about the fact that PEOPLE HAVE TO BE HELD ACCOUNTABLE FOR THEIR ACTIONS? I wouldn’t be able to go and knock some chic out at the club and then it kills her…..but ooooh I didn’t MEAN TO KILL HER….I just punched her lights out judge judy. ha. no way jose….seriously I am all about people making mistakes but when you effect someone else’s life because of it then you hafta be held responsible for it…and NO I don’t think she should have gotten life, persay, although off hand I’m not sure what would have been appropriate? So whatever….GOD is in control and if she is innocent he will let her out, and I do believe in GOD ALMIGHTY and that everything happens according to his will….but RIGHT NOW this chic is RIGHT WHERE SHE BELONGS in my lil ole’ opinion. I mean it’s a pretty open and closed case…..she put salt/seasoning filled with salt in his sippy cup to tire him of food….those are the words outta her own mouth at the trial….and then the doctors CONCLUDE that he died of SALT POISONING right? I mean what exactly is ther not to understand? She made a decision, and in RESULT OF HER DECISION a child DIED. and his name was Andrew and brat or not he didn’t deserve for this MOODY ASS BITCH to go and put fuckin’ SALT up in his drink yo! that was in ebonics foolios.:) PEACE AND JUSTICE FOR ALL. Rest In Peace baby Andrew….may the truth of your death always and forever prevail under God’s almighty hand of JUSTICE indeed.:) oh and just because she is a “CHRISTIAN”….she isn’t a SAINT…only GOD himself is PERFECT….we all here on earth have and will continue to make mistakes everyday….and may the GOD of Peace and Justice forgive us all. AMEN:)

GetFactsRight has the facts wrong.
There are so many inaccuracies I don’t have time to go into all of them. One of the most glaring is that Hannah never said that Andrew was “drifting in and out of consciousness” at home. This was the prosecution’s & investigator’s biased interpretation of what she said.
The crux of this case, according to the Prosecution at appeal, is at what point did Hannah (and Larry) realize that Andrew was in severe distress and what did they do about it?
Spoken at appeal by the Prosecution:
“the crux of our case was not how this child ingested the sodium but the fact that after it ingested the sodium and displayed symptoms like this he was not immediately rushed to the hospital. That’s the crux of our case, Judge.”
Defense:
“. . . we know from that [phone & clinic records] that she left the home within the time frame that their doctor, Dr. Rotta, testified that those symptoms would be full-blown. Within an hour and a half after he had had this freaking out attack when he wanted to — to eat more and she had gone to the other room for her phone, an hour and a half after that his full-blown symptoms would have manifested themselves according to their Dr. Rotta.”
Medical evidence supports that the Overtons acted within a reasonable time frame. Records show that Andrew’s condition when he was brought to medical care was “Pink and diffuse skin. That was again this child was not having fludus capillary refill or signs of active shock . . . That’s their physician.” (Defense attorney)
Like Getthefacts, the prosecution successfully clouded this case with much irrelevant information.
As to “What other parents have ever been prosecuted in Nueces County or in any other County in Texas for withholding medical care.” — Look up Martha Vasquez and her husband. Recent case in Gregory.

This is the email I sent to the DA after watching the 20/20 on We show and investigating this case on the internet tonight. As i write this email in tears I pray with all I have that Hannah gets out of jail NOW! There are five children who are paying the price for this prosecutors choice to convict an innocent mother.
This is the email i sent to the prosecutor just now:
Sandra Eastwood: I pray with all my heart, might, and strength that you soften your heart and let God touch you with the truth of Hannah’s innocence. There are five children WAITING FOR YOU to do the RIGHT THING and LET HER GO HOME. I prayed about this and I know she is not guilty. Please, soften your heart. Every day that goes by is another day she is in that horrible jail and another day those five children pay the price for your over zealous prosecution. Please I beg of you to DO THE RIGHT THING and set her free.
I know you are a good person and I know you LOVE children and you really thought she did this on purpose but GOD knows she did not and even though I never even heard of this case until seeing it on WE 20/20 tonight I know with all my being that she is not guilty because I prayed about it. Please ask God if she is guilty. He will answer you. I promise. Prove me wrong. You won’t be able to. If you ask him a yes or no question you will know the answer. If it is yes you will feel an overwhelming fullness of your heart confirming the truth to you. If the answer is no you will feel like you are not getting a sure answer and just cannot tell. I am so worried about her being apart from her children and husband and what this will do to them to grow up without her. DO THE RIGHT THING! I know you are a good person and will choose the right. Warm Regards, Rhonda McCardle Kyle, TX

I saw her story on 60 minutes & can’t believe that she was convicted.
Jurors should be tested before being selected : some kind of basic logic test. The jurors that found her guilty must have been retards.
The prosicuter was a monster & the judge incompetent at best.
